Terms of Service

These terms govern your use of the NYS Steep-Slope & Wetlands Analyzer at lyncview.com (the “Service”), operated by LyncView (“we”, “us”). By using the Service you agree to them. If you don't agree, don't use the Service.
1. What the Service is — and is not
The Service computes planning-level estimates of steep-slope coverage and mapped wetland acreage for New York State parcels, from public GIS data: USGS 3DEP elevation, NYS Tax Parcels, and the NYS DEC Environmental Resource Mapper. Results can be exported as PDF reports and georeferenced CAD files.
The Service is not a survey, jurisdictional determination, or wetland delineation. Outputs are automated estimates derived from third-party data that may be incomplete, out of date, or inaccurate for any given parcel. They are intended for early-stage screening and due diligence only. Before relying on slope or wetland conditions for a purchase, design, permit application, or any regulatory filing, engage a licensed land surveyor, professional engineer, or qualified wetland consultant. Regulatory boundaries (including DEC and Army Corps jurisdiction) are determined by the agencies, not by this Service.
2. Accounts
- You can use the analyzer without an account. An account lets you sign in to restore purchases across devices.
- You're responsible for your credentials and for activity under your account. Use a strong, unique password.
- You must provide a valid email address and be at least 18 years old (the Service is a professional tool, not directed at children).
- You can delete your account at any time from the account page; see the Privacy Policy for what happens to your data.
3. Plans, payments, and refunds
- On-screen analysis is free. Exports are paid: a one-time report pass (24 hours of unwatermarked PDF + CAD export) or a Pro subscription (monthly or yearly), billed through Stripe.
- Prices are shown at checkout. Taxes may be added where required.
- Subscriptions renew automatically until canceled. Cancel any time from the billing portal (linked from your account and the pricing page); access continues to the end of the paid period. No partial-period refunds.
- Report passes are delivered immediately. If you bought one by mistake and haven't exported anything, email support@lyncview.com within 14 days and we'll refund it.
- If a payment fails or is disputed, we may suspend paid features until it's resolved.
4. Acceptable use
- Don't attempt to breach, probe, or overload the Service, bypass the export paywall, or share paywalled deliverables in ways that substitute for a purchase.
- Don't scrape or bulk-harvest the Service programmatically. (Need volume or API access? Ask — that's the Team plan.)
- Don't misrepresent Service output as a survey, delineation, or professional certification.
- Underlying public data remains subject to its providers' terms (USGS, NYS ITS GIS, NYS DEC).
5. Your exports
You own the reports and CAD files you export and may use them in your projects and client work. The disclaimer language embedded in exports must not be removed.
6. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. UPSTREAM DATA SERVICES MAY BE UNAVAILABLE OR RETURN INCOMPLETE DATA AT ANY TIME.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNCVIEW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST DEALS, PERMIT DENIALS, CONSTRUCTION OR REMEDIATION COSTS — ARISING FROM USE OF THE SERVICE OR RELIANCE ON ITS OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE (OR $50 IF YOU PAID NOTHING). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
7. Changes and termination
We may change or discontinue features, or update these terms; material changes will be posted here with a new “last updated” date, and continued use means acceptance. We may suspend accounts that violate these terms. You may stop using the Service at any time.
8. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York.
